Recent Case Results September 2018


In December of 2015, our client was involved in an accident where she was rear-ended while sitting in traffic on Rt. 50. The defendant had claimed that she, herself, was rear-ended and the person fled the scene, which forced her into the back of our client’s vehicle. However, our client stated she saw no one drive off in an aggressive manner. Also after Maryland State Police examined the defendant’s vehicle at the scene, a minor scratch was noted, but nothing that would have resulted in her being pushed into another vehicle. Liability was accepted by the defendant’s insurance company, unfortunately there was only $30k available on the policy. After our client was through with treatment she had incurred almost $90k in medical expenses. Luckily, the assigned paralegal, Mrs. Christine Airey, is highly experienced and knew she could find additional coverage for her client. After accepting the $30K from the defendant’s insurance carrier, Mrs. Airey was able to obtain an additional offer of $188k from the client’s underinsured motorist coverage. Needless to say our client was very pleased with her final result and was thankful for all the hard work Mrs. Christine Airey put into her case.

Join us in welcoming Cindy to the Portner & Shure family. She has been with us for one month now and works as a receptionist and legal assistant. Cindy was born in the United States, but her family is from El Salvador. Cindy is fluent in Spanish and works with our Spanish department. She currently attends Bowie State University and is finishing up her last year. Cindy has a younger brother and a dog named Prince that she likes to spend time with. Outside of work, Cindy is a diehard Redskins fan and a Barcelona soccer fan. She also enjoys cooking and travelling.

Maryland Car Accident Lawyer: New 70 mph Speed Limit Takes Effect in Parts of the State

            Yesterday, new 70 mph speed limits took effect along 76 miles of I-70 in Frederick County to Washington County, Maryland.  In addition, a 31-mile stretch between US 29 in Howard County to MD 144 in Frederick County and a 45-mile stretch from MD 180 to the Pennsylvania line saw speed limits increase from 65 mph to 70 mph.  These stretches of highway run through rural areas and do not include areas within the city of Frederick due to safety concerns.
            
           With increased speed limits, it is even more important for drivers to pay attention to the road and avoid distractions, such as cell phones, while operating their vehicle.  Faster cars also mean an increased risk of more severe car accidents.  Before implementing these speed limit changes, numerous studies were conducted to make sure that safety would not be compromised with a faster speed.  In making this change the State Highway Administration says that they expect “to see more consistent travel speeds for vehicles, keeping I-70 conditions safe for thousands who travel the route each day.”

Maryland Accident Attorney: Case Result March 2016

           Portner & Shure settled a pedestrian accident case for our injured client for $65,000.  The incident occurred in the parking lot of our client’s place of employment in Salisbury, Maryland.  Our client was walking in the parking lot at work when she was struck by a car.  Although there were no broken bones, our client suffered injuries to her neck, back, arms, and legs.  Medical bills totaled more than $46,000 for our client. 


Our paralegal, Pam Brown, negotiated a settlement with the insurance company for $65,000.  Since the accident happened in the parking lot of her job, she was entitled to workers’ compensation benefits as well.  A lien for more than $51,000 was due to be paid, however, Pam negotiated a deal with the workers’ compensation carrier to write off the entire lien.  So in reality, the recovery was $97,000 in a case with no broken bones or significant injuries.

Maryland Auto Accident Lawyers: Fatal Accident in Bethesda Kills 3, Seriously Injures Another

            Saturday night, a horrific accident occurred in Bethesda on Pyle Road.  Two cars were involved in the accident, a Chevrolet Volt and a BMW sedan.  There were 4 passengers in the Volt and they were the ones struck with tragedy.  Three of the passengers did not survive the crash, and the fourth passenger suffered life-threatening injuries.  The young driver of the BMW only suffered minor injuries.
            
            The cause of this devastating crash has not been determined yet.  Since it was a Saturday night, it is always possible that alcohol played a role.  Based on accident scene pictures, the Chevrolet Volt suffered significantly more damage than the BMW.  Whatever the cause may be, it is likely that one of the parties was at fault.  This area of Bethesda is a residential area, therefore, with the amount of damage to the Volt vehicle, speed is a likely factor in the crash.

Bel Air Car Accident Lawyers, I95 Motor Vehicle Fatalities

Recently, Harford County has seen a startling spike in motor vehicle accident fatalities on I-95 between Route 24 and Route 152.  At the height of the holiday season, and with gas prices at their lowest levels in years, more Marylanders are on the road than ever.   The improving economy and surge in online gift buying has also caused an expansion of the volume of trucks sharing the roads.    
On December 9, 2015, a three vehicle accident on I-95 north resulted in the tragic death of a 21 year old Baltimore County woman.  The initial impact occurred between her pickup truck and a tractor trailer.  After striking the jersey wall, the pickup truck rebounded into another woman’s vehicle.  The driver of that vehicle was rescued in critical condition after being extricated from the wreckage.   All northbound and southbound lanes were closed for the medevac helicopter to land on I-95 south, causing traffic backups nine miles long.
Only two days later, on December 11, 2015, another fatal crash occurred in nearly the same location.  A Honda Accord that had led police on a chase from Eastern Avenue in Baltimore City onto I-95 northbound lost control and crossed the grassy median, causing a head on collision with a Kia Sorrento heading southbound.  Both vehicles were carrying two passengers.  One passenger in each vehicle was killed in the crash, amounting to two fatalities.  Four people were taken to the University of Maryland Shock Trauma Center, one by medevac  helicopter.   Again, both northbound and southbound lanes on I-95 were closed for the helicopter to land on the highway.

Litigation News August 2015

            Portner & Shure recently won $20,735 for a client injured in a Maryland car accident in Montgomery County.  Our client was hit at a red light and there was a dispute as to whether a lane change caused the crash.  We had an independent witness to the accident, yet the Defendant’s insurance carrier denied liability and never made a settlement offer.  Our client’s total medical costs were just over $6000.  Counsel for the Defendant refused to concede liability and just proceed on the damages only at trial.  The Court found the Defendant liable.  Our trial attorney in this case was Kevin Ruby.
