Recent Case Results November 2017

Earlier this month, our litigation manager was able to settle a case that was court bound by getting the insurance company to increase their offer. Our client was involved in an accident where the defendant ran a stop sign, t-boned her, and one other person. The insurance company was claiming minimal property damage and they didn’t see her case being worth more than $4,000.00. After our litigation manager got involved and threatened to file suit, the insurance company agreed to raise their offer by $1,500.00. Our client was very pleased with her final offer and her experience with our firm.

Maryland Live! Casino Faces Lawsuit: Man Alleges Roulette Ball Struck Eye

            A lawsuit has been filed by a Washington, D.C. man based on allegations that he was injured after a roulette ball hit his eye.  In December 2013, a Maryland Live! Employee was operating the roulette wheel and according to the man, the employee “negligently” caused the roulette ball to go airborne and hit the man’s left eye.  After injuring his eye, the man also alleges that another casino employee squeezed eye drops into his eye without his permission.  The drops then allegedly caused him to become “disoriented” and made him hit his head and become unconscious.  The Washington, D.C. man is suing the casino as well as the developer, the Cordish Companies, for $150,000.  Last week, Cordish Companies attorneys tried to get the lawsuit dismissed, but a judge denied their motion.
            
            This is certainly an interesting case because we would never expect a lawsuit arising out of a game of roulette in a casino.  Due to the alleged negligent operation of the roulette wheel, the ball went airborne and struck the plaintiff, immediately causing “sharp and severe pain” and disorientation.  A casino security guard then escorted the plaintiff to a private room to lay down, however, the guard proceeded to administer eye drops without the plaintiff’s consent.  Because of a contusion in the injured eye, the drops exacerbated the problem, causing blurriness and more pain.  The lawsuit claims, the “unwanted and willful act of placing unidentified liquid directly into Plaintiff’s eye amounted to a battery to his person done in wanton and reckless disregard for plaintiff's rights to be free of unsolicited medical treatment and/or other batteries to his person and rise therefore to the level of malice.”

Yesterday, it is likely that many children woke up to a brand new bicycle, scooter, skateboard, or pair of roller blades sitting under their Christmas tree.  A helmet and other protective gear should also be included with these gifts since they can be dangerous activities when proper safety precautions are not taken.  Young children are more likely to get severe injuries to their head, arms, and legs when riding a bike, scooter, or skateboard and falling off.  Most injuries can be prevented by wearing protective gear such as helmets, elbow pads, and knee pads.  Any bicyclist who does not wear a helmet is at increased risk of head injury.  A national survey has shown that only 48% of children ages 5-14 years wore bicycle helmets when riding.  Most children find helmets to be uncomfortable and “uncool,” but they don’t realize they can also save your life by protecting your head from serious injury.  Parents and older siblings need to set a good example for the younger children by showing them that wearing a helmet is the “cool” thing to do.

            When getting your child a helmet, make sure it is the proper size and that it is tightened and secure when on their head.  Do not let your child be the one who gets seriously injured or even killed from not wearing a properly fitting helmet when riding their new bike, scooter, skateboard, or pair of roller blades.  Make sure your children are safe when playing with their new toys while riding them into the New Year.

Maryland, Virginia Personal Injury Attorney: Airbag recall Affects Millions of Cars


Millions of cars from almost a dozen auto makers are affected by a serious and dangerous recall due to defective airbags. Over five million Honda vehicles could have the issue, nearly one million Toyota vehicles, almost 700,000 Nissan vehicles, and more than 600,000 BMW vehicles are affected. A significant number of Chrysler, Ford, General Motors, Mazda, Mitsubishi, and Subaru vehicles are all affected. Years for these vehicles range from 2000 to 2011 depending on the specific model. The reason for the recall is due to defective inflators made by Japanese parts supplier Tanaka that explode too strongly and send metal shrapnel through the bag into people. However, the government is only reporting three injuries and is continuing to investigate. Federal regulators are urging owners of these affected vehicles to
"take immediate action." 2014 has been the worst year for auto recalls in U.S. history, with more than 1 in 5 cars and trucks at risk of defects.

How to Prevent Your Dog from Biting

Even good dogs become aggressive when their territory, food, or young are threatened. Sometimes accidentally or unknowingly stepping on or harming a dog could trigger a bite. The truth that we do not forget is that no matter how well trained or how well behaved our dogs are, the possibility of biting is always there.

1)      Train: This is crucial in taking control of your dog and preventing dog bites.
